1. General Policy
Phan Software provides customized website development, software development, domain management, hosting, and technical support services.
Refund eligibility depends on the service purchased, the amount of work completed, the stage of delivery, and any applicable legal requirements.
Nothing in this Policy removes cancellation, refund, or other rights that cannot legally be excluded.
2. Preliminary Design and Demo Services
Fees for preliminary design or personalized demo services are non-refundable once the applicable work has commenced, except where required by law or expressly agreed otherwise.
Applicable fees and any credits toward a final project will be disclosed on the relevant service page or at checkout.
If Phan Software cancels the associated project for reasons not caused by the Customer, all project-related payments, including preliminary design and demo fees, will be fully refunded.
3. Customer Cancellation Before Development Begins
If the Customer cancels before development work begins, Phan Software will refund payments for unperformed development services.
Separately completed preliminary services and authorized, non-recoverable third-party expenses may be deducted where permitted by law and the applicable agreement.
4. Customer Cancellation During Development
Customers may request cancellation while development is in progress.
Refunds will be based on the portion of the project that has not yet been completed.
The calculation will consider:
- Completed milestones and deliverables.
- Documented design and development work.
- Approved additional services.
- Authorized non-recoverable third-party expenses.
- The agreed project scope and pricing.
Phan Software will provide a reasonable breakdown of the calculation.
Where milestone values were agreed in advance, those values will be used as the primary basis for calculating completed work.
For partially completed milestones, a reasonable proportion of the milestone value will be assessed based on documented progress.
Refund Formula
Refund = Payments received − completed work value − authorized non-recoverable expenses
The refund cannot be less than zero. Any separate amount claimed as outstanding must be supported by the applicable agreement and law.
Example: $1,500 Website Package
A Customer purchases a CAD $1,500 website development package.
Assume:
- Total payments received: $1,500.
- Completed work value: $900.
- Authorized non-recoverable expenses: $100.
The cancellation refund is:
$1,500 − $900 − $100 = $500
The Customer receives a CAD $500 refund.
This is an illustrative calculation. Actual refunds depend on the agreed scope, documented progress, and applicable law.
5. Cancellation by Phan Software
If Phan Software cancels a project for reasons unrelated to Customer breach, misconduct, or failure to fulfill material contractual obligations, the Customer will receive a 100% refund of all amounts paid for that project.
This includes preliminary design fees, demo fees, development payments, and other project-related charges collected by Phan Software.
For example, if the Customer paid CAD $1,500 and Phan Software cancels the project for its own operational reasons, the Customer receives a CAD $1,500 refund, regardless of the amount of work already completed.
Any additional rights or remedies required by law remain available.
6. Completed and Approved Projects
After the Customer approves the completed project, payments attributable to completed and conforming development work are ordinarily non-refundable.
Approval does not eliminate rights arising from material defects, non-delivery, misrepresentation, breach of contract, or applicable law.
7. Source-Code Requests
After final approval and full payment, the Customer may request available project-specific source code.
There is no additional charge for requesting or receiving the source code.
Once the requested source code has been delivered, payments for the approved and completed development work are non-refundable under Phan Software's voluntary refund policy.
This restriction does not exclude any mandatory legal rights or applicable contractual warranties.
8. Hosting Subscriptions
Hosting subscriptions may be cancelled before the next renewal.
Unless otherwise stated, cancellation takes effect at the end of the current paid billing period.
Unused portions of a billing period are not routinely refunded for voluntary cancellation, except where required by law or expressly agreed.
If Phan Software fails to provide a material portion of the contracted hosting service, appropriate remedies may apply.
9. Maintenance and Support Subscriptions
Customers may cancel maintenance and support subscriptions before their next renewal.
Unused support time does not roll over or automatically qualify for a refund unless the selected plan states otherwise.
Failure to provide contracted services may entitle the Customer to an appropriate remedy.
10. Domain Registration and Renewal
Domain registration and renewal charges are generally non-refundable after successful processing by the applicable registrar or registry, except where permitted by the provider or required by law.
If Phan Software cannot successfully register a purchased domain and the Customer does not accept an alternative, the unsuccessful registration charge will be refunded.
11. Domain Transfers
Customers may request transfer of eligible domains away from Phan Software's management.
Phan Software does not impose an additional administrative charge for standard domain transfers.
Fees charged by the receiving registrar or applicable third-party provider are the Customer's responsibility.
Previous registration, renewal, and management charges are not automatically refunded because a domain is transferred.
.CA Domain Transfer Conditions
A .ca transfer or change of registrant must satisfy applicable CIRA and registrar requirements.
The proposed registrant must meet CIRA's Canadian Presence Requirements.
The Customer must provide accurate information and any necessary eligibility documentation.
Registrar transfers may be restricted within 60 days of initial registration or a previous registrar transfer, subject to applicable exceptions.
Changes of registrant follow separate procedures and may have different requirements.
12. Third-Party Expenses
Authorized third-party expenses may be non-refundable when already incurred and not recoverable from the provider, subject to applicable law.
Such expenses must be properly disclosed and approved.
13. Refund Requests
Customers may submit cancellation or refund requests by contacting:
Email: billing@phansoftware.ca
Website: https://phansoftware.ca
Requests should include the order number, service, and reason for cancellation.
Phan Software aims to acknowledge requests within three business days and provide an initial assessment within ten business days.
Statutory deadlines take precedence over these internal targets.
14. Refund Processing
Approved refunds will ordinarily be returned to the original payment method where possible.
Processing times depend on the payment processor and financial institution.
Refunds required by law will be processed within the applicable legal deadline.
15. Payment Disputes
Customers may contact Phan Software to resolve billing concerns.
Nothing in this Policy restricts a Customer's right to contact their payment provider, initiate a legitimate payment dispute, or exercise legal remedies.
16. Changes to This Policy
Phan Software may update this Policy periodically.
Changes will not retroactively remove rights under an existing agreement where prohibited by law.
